The announcement comes after President Barack Obama’s chief of staff, Rahm Emanuel, issued a memorandum on January 20, 2009 to all federal agencies directing them to consider extending for 60 days the effective date of regulations that have been published in the Federal Register but not yet implemented. The memo also put a freeze on many federal regulations not yet published in the Federal Register.
According to USCIS, the delay will provide Department of Homeland Security (DHS)with an opportunity for further consideration of the rule and also allows the public additional time to submit comments. USCIS has also reopened the public comment period for 30 days, until March 4, 2009.

Management should continue using the I-9 form with an expiration date of June 30, 2009 and not the I-9 form with a revision date of February 2, 2009 until the new implementation date.
