On Friday, Governor Gavin Newsom issued Executive Order N-63-20, which extends certain procedural deadlines affecting employers due to the impact of the COVID-19 pandemic. Any of the following deadlines that normally would have fallen within 60 days of the date of the Order (i.e., between May 8, 2020 and July 7, 2020) are extended by an additional 60 days:
- The deadline for the Labor Commissioner to issue any citation under the labor Code (which varies depending on the type of claim);
- The deadline for an employer to appeal or petition for review of any citation issued by the Labor Commissioner (normally 10 days);
- The deadline for employees to file complaints with the Labor Commissioner (which varies depending on the type of claim) and the Labor Commissioner’s deadlines related to initiating proceedings;
- The deadline for Cal/OSHA to issue citations to an employer (normally 6 months);
- The deadline for an employer to appeal or contest a citation issued by Cal/OSHA (normally 15 working days).
